These Terms of Sale apply to consumer purchases from Filmhawk Shop. The seller and contracting party is FILMHAWK LIMITED. Please read them before submitting an order.
Products and availability
We sell photography, video, content-creator, studio and equipment-organisation accessories and related products displayed on the website. Product information, dimensions, compatibility and included components are stated on the relevant product page. Availability can change. Placing an item in a basket does not reserve it.
How the contract is formed
Your checkout submission is an offer to buy. An automated acknowledgement confirms receipt but does not by itself mean the order has been accepted. A contract is formed when we send an acceptance or dispatch confirmation, or otherwise clearly confirm acceptance. If we cannot accept the order, we will notify you and refund any payment taken.
Prices VAT and payment
Prices are shown in pounds sterling and include VAT where applicable unless clearly stated otherwise. The total payable amount is displayed before you confirm payment. Standard UK shipping is free. We accept payment methods shown at checkout. Payment must be authorised before fulfilment.
We may correct an obvious pricing error before accepting an order. If we discover an error after payment but before acceptance, we will ask whether you wish to continue at the correct price or cancel for a full refund. We will not increase the price of an accepted order without your agreement.
Delivery
We deliver only within the United Kingdom under the Shipping Policy. The estimated delivery time is 3 to 5 business days after order confirmation. Risk passes to a consumer when the goods are delivered to the consumer or a person identified by them, subject to applicable law. Legal title passes when full cleared payment has been received and the goods have been delivered.
Cancellation returns and refunds
Eligible consumers may cancel and return goods as described in the Return and Refund Policy and under UK law. Our voluntary policy allows return or exchange requests within 14 business days after delivery, with approved return costs paid by us. Approved refunds are submitted within 3 business days after we receive and inspect returned goods. Statutory rights apply independently of this voluntary promise.
Product conformity and consumer rights
Goods must be as described, of satisfactory quality, fit for any purpose made known to us and supplied with reasonable care. Nothing in these terms restricts remedies under the Consumer Rights Act 2015 or other mandatory law. If goods fail to conform, contact us for an appropriate remedy.
Personal use and resale
Unless we agree otherwise in writing, products are supplied for personal or domestic use. We may limit quantities or refuse orders where there is reasonable evidence of fraud, unauthorised resale, misuse, sanctions risk or other unlawful activity. Any refusal will not affect an existing statutory right.
Our responsibility
We are responsible for foreseeable loss or damage caused by our breach of contract or failure to use reasonable care and skill. We are not responsible for loss that was not foreseeable, loss caused by information or actions outside our reasonable control, or business losses arising from a consumer purchase. Nothing excludes liability that cannot legally be excluded.
Events outside reasonable control
We are not liable for delay caused by events outside our reasonable control, but we will take reasonable steps to reduce the effect, provide updates and respect any statutory right to cancel if delivery is materially delayed.
Complaints disputes and governing law
Contact customer support first and we will try to resolve the issue fairly. We do not currently subscribe to a specific alternative dispute resolution provider. This does not affect your right to use any dispute-resolution route available by law or bring a claim in a competent court.
These terms are governed by the laws of Scotland. Consumers retain mandatory protections of the part of the United Kingdom where they live, and may bring proceedings in courts available to them under applicable consumer rules.
